I've had some interesting conversations in the past few weeks about the new 96db law and some of the fallout from how we got there. Here are some observations:
There WILL NOT be a competition excemption for 96db on ATV racing in the forseeable future. This is based on a few things, not the least of which is an unwillingness by some "high profile" ATV competion associations to acknowlege the issue and even go as far as "thumbing their nose" at those who want quiet. Guess who won that round.
The biggest issue standing in the way is the use and description of "race only/competion" ATV's. Unlike snowmobiles and motorcycles, most racing ATV's are also used on the trail. Also factor in Ice Racing which is done on public lakes right alongside the "I was here first and your scaring the fish" ice fishermen and often a few hundred feet from the quaint lakeshore homes. You can go on all you want about what the word "public" means but THEY LIVE THERE. No one at the state level is accepting the argument that the loud racing quads will somehow be quiet on the trail. They have all those complaints from the lakeshore people already and there are far too many old 4-strokes with their riders "claiming" to have them set up for racing out there pissing people off with Cobra and Supertrapp cans at maximum rappage.
No one I've talked to has any complaint on the amount of noise produced at the races. Not a one of them believes the quads racing on Saturday won't be on the trail or ice with the same amount of noise the rest of the week. That my friends has doomed any chance of a race excemption.
Yea, that redneck with the clapped out loud '94 300EX claiming "loud pipes save lives" or some other similar crap who feels the need to pissoff everybody has screwed me, you and everybody else on this deal because now NO ONE that we need to help us believes for a second these "race only" quads will stay "track only". Take a good look around and tell us they're wrong. Check out the trails (especially the snowmobile trails- -where EVERYBODY notices stuff) and you'll see. As a "useage group" we have zero credability.
So here we are. Make them quiet because by the time we hit the 2005 season DNR wardens WILL be showing up on the lakes and trails checking for 96db. And guess what? It's gonna take a court case to decide the track issue because once you open up the gates for the public SOMEONE will try to enforce the law. Any ATV activity at places like Dyracuse or Tigerton will fall under this as well because they're ATV trails anyway.
